Good day

 

Please be advised that as the owners informed us, although Aftab company is the cargo owner, but the Charterer is the only party to whom the Owners can deal as per the CP. Also the charter party dated 29th April 2022, which has been extended over multiple periods, very clearly mentions the trading area as Persian Gulf except FOTT Terminal. However, although it is not mentioned in the charter party, for the sake of good cooperation and despite the strict regulations of the FOTT, owners tried their best to find a way for calling FOTT, and they have been informed that a detailed voyage order with three different parcels and three different BLs is needed and to be confirmed by cargo receiver as well.

 

Please be noted that the owners declared that with consideration of all of the matters and the risks of the black listing the vessel and possibility of huge cost for the owners and the charterers, the owners avoid to call the FOTT. And if the charterers still want to go ahead, it is as per their risk, time and consequence.

Ref. to your below message and our earlier telecon. please note that despite of point mentioned about the TCP, please note the agreement for such operation and involved risk is between the vessel and Aftab company.

If everyone is confident over the suggested scenario and believe by having 3 B/Ls the problem and risk for the vessel in FOTT will be sorted out, we as charterer does not have any comment but in any case if the owner is believe it may lead the vessel to heavy risk, black listing in region or even detention it will not be taken by charterer and shall be compensated by owner and Aftab.

Please be advised that as the owners informed us, despite exclusion of FOTT as the discharge port in the TCP, in the last 2 voyages they did FOTT voyages to cooperate with the Charterers, but they faced with the FOTT's strictness.

 

Please be noted that the owners advised that ideally, if the Charterers can break the cargo into three parcels and with different bills of lading, then the owners can make an attempt to get the maximum berthing time.
